01 Who we are and what these terms cover

This website, funup.gr, is operated by KAIKILIA ZEMPILA (ΚΑΙΚΙΛΙΑ ΖΕΜΠΙΛΑ), a sole proprietorship trading as “Fun Up” (“Fun Up”, “we”, “us”):

These Terms of Use (“Terms”) govern your use of this website and set out the general framework of our services. By using the website or submitting a quote request, you accept these Terms. If you book an event with us, the individual written offer and booking confirmation you receive contain the specific commercial terms of your booking (price, deposit, payment schedule, cancellation terms, what's included) and prevail over these Terms where they differ.

02 Our services

Fun Up provides games and entertainment experiences for events — giant games, lawn games (such as Giant Jenga, cornhole, ring toss), and curated activity stations — for weddings, corporate events, private parties, brand activations, and similar occasions, based in Athens, Greece. The website presents our services and lets you request a personalised quote. The exact equipment, staffing, duration, and pricing for any event are defined in the written offer prepared for that event.

03 Quote requests and bookings

  • Submitting the quote request form does not create a contract — it is a request for us to prepare an offer. There is no charge and no obligation.
  • A booking is confirmed only when we have issued a written offer or confirmation, you have accepted it, and any deposit stated in it has been paid.
  • Each offer states its own validity period, pricing, deposit, payment, and cancellation terms.
  • Please provide accurate event details (date, location, guest count, venue access, available space, and power supply if required) — our offer is based on them.
  • You must be at least 18 years old to submit a quote request or make a booking.
  • Our services are the supply of leisure/recreation activities for a specific date or performance period. For that reason, under Article 3ιβ(ιβ) of Greek Law 2251/1994, the 14-day withdrawal right for distance contracts does not apply. The cancellation terms for your booking are set out in your written offer.
  • We reserve the right to decline a booking request for objective reasons — for example unavailability for the date, venue unsuitability or restrictions, or safety concerns. We do not decline bookings on any grounds of discrimination prohibited by law.

04 At the event — responsibilities

We are responsible for: delivering, setting up, running, and removing the agreed equipment and activities on the agreed date; providing equipment that is clean, safe, and in good working order; and arriving within the agreed set-up window.

You are responsible for: ensuring the venue permits our equipment and activities and obtaining any permissions the venue requires; providing a safe environment for set-up and operation; reasonable supervision of your guests; and loss of or damage to our equipment caused by you or your guests during the event, beyond normal wear and tear.

Our activities are meant to be enjoyed responsibly. We may pause or stop an activity if we reasonably believe it is being used unsafely, and we are not liable for injury or damage resulting from misuse of equipment or failure to follow reasonable instructions given by our staff.

05 Acceptable use of the website

You agree not to: use the website unlawfully or in a way that could damage or overload it; attempt to gain unauthorised access to any part of it or its systems; submit false, misleading, or third-party information through our forms without authority; or use automated tools to scrape or copy its content. Unauthorised access to an information system may also carry criminal liability under the Greek Penal Code.

06 Intellectual property

The Fun Up name, logo, brand elements, and the texts and design of this website belong to Fun Up. Some photographs and videos shown on the website are third-party material that we use under licence — they remain the property of their respective owners. No content from this website may be reproduced or reused without our prior written permission and, for licensed material, the permission of its owner. You may view and print pages for personal, non-commercial use.

07 Event photography

We sometimes photograph or film our games in action for our portfolio and marketing — but only where this has been agreed with you as part of your booking. If you do not want images from your event used, tell us in writing before the event and we will respect it. To the extent that your guests — who are third parties — appear in this material, you as the organiser undertake to inform them about any photography or filming and to ensure whatever the GDPR requires for their images.

08 Third-party links and social media

The website may link to third-party sites and to our social-media profiles (such as Instagram). We are not responsible for the content or privacy practices of third-party sites; their own terms apply.

09 Liability

The website is provided “as is”: we work to keep its information accurate and the site available, but we do not guarantee it will be uninterrupted or error-free, and its content does not constitute a binding offer until confirmed in writing. The “as is” statement concerns only the availability and operation of the website; it does not limit the statutory guarantees of conformity and quality for the event services we provide, which apply under Greek Law 2251/1994.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so under Greek law — including liability for death or personal injury caused by negligence, or for gross negligence or wilful misconduct. Subject to that, our total liability in connection with a booking is limited to the total fees paid for that booking. This limit does not apply where we breach an essential (cardinal) contractual obligation; in that case we are liable for the loss that was typically foreseeable when the contract was concluded. We are not liable for losses that are not causally connected to our service or were not reasonably foreseeable. Your mandatory rights as a consumer under Greek and EU law are not affected by these Terms.

10 Privacy and cookies

We handle your personal data as described in our Privacy & Cookie Policy, which also explains the cookies and tracking tools this website uses and how to manage them.

11 Changes to these terms

We may update these Terms from time to time. The version that applies to a booking is the one in effect on the date the booking is confirmed. Any material changes are notified in advance in a reasonable manner and do not apply retroactively to bookings already confirmed. The “Last updated” date at the top of this page shows when the current version took effect.

12 Governing law and disputes

These Terms are governed by the laws of Greece. Any dispute relating to them or to the use of this website is subject to the jurisdiction of the competent courts of Athens, without affecting any mandatory consumer-protection rights you have under Greek and EU law. If you are a consumer, you may also refer a dispute to the Greek Consumer's Ombudsman (www.synigoroskatanaloti.gr), an out-of-court dispute-resolution body.
